Leiekontrakt på engelsk

En husleiekontrakt kan skrives på engelsk, og den er like bindende som en norsk. Husleieloven gjelder uansett hvilket språk avtalen er på, og vilkår som stiller leietakeren dårligere enn loven, er ugyldige også i en engelsk tekst. Har du begge versjoner, bør kontrakten si at den norske går foran ved uenighet.

Husleieloven er ufravikelig til leietakerens fordel. Et vilkår som er ugyldig på norsk, blir ikke gyldig av å bli oversatt.

Si hvilken versjon som gjelder

Bruker du både norsk og engelsk, skriv inn at den norske teksten går foran ved uenighet. En tvist behandles på norsk av en norsk domstol, og da er det den norske ordlyden som blir lest.

Leietakeren må forstå det han signerer

En leietaker som ikke forstår norsk, kan i verste fall hevde at han ikke forsto vilkårene. En engelsk versjon ved siden av fjerner den innsigelsen — og er dessuten enkelt vanlig folkeskikk.

    The tenant pays a deposit of __________ NOK. The amount is placed in a separate deposit account in the tenant's name. The account is blocked for both parties for the duration of the tenancy, and the landlord covers the cost of opening it. Interest accrues to the tenant.

  5. 5. Termination

    The notice period is 3 months, counted from the end of the calendar month in which notice was received. Notice given by the landlord must be in writing, state the reason, and inform the tenant of the right to object in writing within one month. Without that information, the notice is invalid.

  6. 6. Rent adjustment

    The rent may be adjusted in line with the consumer price index once a year, at the earliest one year after the previous adjustment, and with at least one month's written notice.

  7. 7. Maintenance

    The tenant is responsible for simple maintenance: light bulbs, fuses, door locks, taps, and clearing drains. The landlord is responsible for the property and its fixed installations. The tenant must report damage without undue delay.

  8. 8. Access to the property

    The tenant has exclusive use of the property. The landlord must give reasonable notice before visiting, and may enter without agreement only to prevent imminent damage.

  9. 9. Handover and return

    The parties carry out a documented handover at move-in, with photographs of each room, a meter reading, and the number of keys handed over. The same walkthrough is done at move-out, and the two are compared. The property is returned in the same condition as at handover, apart from normal wear and tear.

  10. 10. Mandatory rules

    The Norwegian Tenancy Act (husleieloven) governs this tenancy. Terms that leave the tenant worse off than the Act are void, even if both parties have signed.
